Enforcement Notice Advice

If a Council has contacted you regarding a potential breach of planning, either through the serving of a Planning Contravention Notice (PCN) or an Enforcement Notice, then GSP can assist in responding and liaising with the Council and client.

In some cases, where appropriate, GSP can encourage a Council to allow the submission of a retrospective planning application or an application seeking a certificate to confirm the lawful status of a use or development, ultimately helping to avoid enforcement action altogether to the benefit of both the Council and the client.

In other cases, GSP can act on behalf of a client to challenge the serving of an enforcement notice at appeal if adequate grounds exist. GSP has vast experience in dealing with enforcement appeals covering all three appeal procedures: written representations, hearing or public inquiry.

GSP can assist in minimising the issues by negotiating with the Council, seeking a separate planning permission for an aspect of the Council’s issues where possible, or agreeing a statement of common ground, all helping to limit the overall cost of the appeal to the benefit of the client.
